US patent system

The question of Intellectual Property protection needs to become an issue that is widely discussed, as the US patent office is being snowed under by ridiculous claims (Smuckers tried to patent peanut butter sandwiches !). Originally, patents were a means of giving a financial reward to inventors for their labor. But from protective patenting of an original idea, the US is moving into using patents as a more defensive tactic, and corporations are trying to cover business practices and broad ideas, so as to limit competition. A "build a moat" around the product type of strategy. So lawyers in the US are increasingly using patent law for tax purposes, blackmail, unfair or restriction of competition. The Blackberry settlement is a case in point. Beyond greed, there are ethical issues involved in granting patents on proteins, genes, life forms, organisms and, why not,  clones. There is a call here for a restructuring of patent rights to encourage innovation, but not bias competition. More on this in this editorial in the New York Times.
